Modification of transitional rules on UBO obligation postponed
A few weeks ago, we informed you about a change as of 1 June this year in the transitional regime under the UBO obligation. If notaries, accountants and tax advisers, among others, have a new enter into a business relationship, they must verify that your UBO details are registered in the UBO register at the Chamber of Commerce (CoC). Since they temporarily no longer have access to that UBO data, a temporary transitional arrangement has been made so that they can still fulfil their verification obligation. That transitional arrangement was due to change on 1 June this year, but this has now been postponed to 1 August 2024. Are they then going to have a new business relationship with you, then to fulfil their verification obligation, they must request a certified extract from the UBO register from you. You can then request this extract from the Chamber of Commerce.
Tip
Until 1 August 2024, notaries, accountants and tax advisers - and other organisations required to verify UBO registration - can still verify whether your details are registered in the UBO register via a confirmation email from the Chamber of Commerce.
